Car accidents are an unfortunate reality on California's busy roads and arteries. The aftermath of an accident can be overwhelming, regardless of whether it was caused by distracted driving, racing, or hazardous road conditions. It is imperative to comprehend your rights under California's personal injury law if you have sustained injuries in a car accident.
California operates under a fault-based system, which entails that the at-fault motorist is accountable for the cost of damages through their insurance policy. Nevertheless, determining fault is not always a simple process, and insurance companies frequently endeavor to reduce payments. An experienced personal injury attorney can be the deciding factor in this situation.
Injured parties are entitled to pursue compensation for medical expenses, lost wages, property damage, and non-economic losses such as pain and suffering under California law. Even if you were partially at fault, you can still recover damages under California's comparative negligence system; however, your compensation will be proportionally reduced.
It is crucial to respond promptly following a catastrophe. Personal injury claims in California are subject to a two-year statute of limitations. Your case can be fortified by evidence such as medical records, witness statements, and accident reports. Furthermore, early legal intervention guarantees that you are not exploited by insurance adjusters.
