A fatal car accident is an unimaginable tragedy. In addition to the emotional devastation, families are often left facing overwhelming financial burdens, including medical expenses, funeral costs, and the loss of household income or companionship. In California, understanding your legal rights can be an important first step toward finding justice and a path forward.
Fatal crashes can stem from a range of causes, including drunk or impaired driving, reckless behavior, distracted driving, and unsafe road conditions. When another party’s negligence leads to the loss of life, surviving family members may be eligible to pursue a wrongful death claim. This legal action can provide compensation for economic losses, such as lost income and burial expenses, as well as non-economic damages related to grief, suffering, and the emotional impact of the loss.
Under California law, wrongful death lawsuits must typically be filed within two years of the date of the accident. Taking prompt legal action helps preserve key evidence and allows your attorney to begin building a strong case. An experienced wrongful death attorney can guide your family through every stage of the process, from investigating the accident to negotiating with insurers and advocating for full and fair compensation.
