Pedestrian accidents are a significant concern in California, often resulting in severe injuries or fatalities. Factors such as distracted driving, speeding, and failure to yield contribute to these tragic incidents. Under California law, pedestrians generally have the right of way at crosswalks and intersections. When a driver’s negligence leads to a pedestrian's injury or death, victims or their families may pursue compensation through personal injury or wrongful death claims.
Damages can be awarded to compensate for non-economic damages such as pain and suffering, as well as medical expenditures and lost wages. Injured parties can recover damages in California under the comparative negligence system, which allows them to do so even if they are somewhat at fault for the incident, with compensation being modified proportionally. Because the statute of limitations for personal injury claims is two years from the accident date, it is essential to take legal action as soon as an accident occurs.
With the guidance of a seasoned personal injury attorney, it is possible to negotiate the complexities of these cases. This attorney can also guarantee that the rights of victims are honored and that they receive compensation that is legitimately theirs. Thankfully, this is feasible.
